Terms of Service — Eureki

1. Responsible entity
The Eureki application is provided by:

Contract executed under Portuguese law. For all official correspondence, use the email above.
2. Acceptance of Terms
By installing, starting, or using the Eureki app (Android package
app.eureki), you fully accept these Terms of Service and our
Privacy Policy.
If you disagree with any clause, do not use the app and uninstall it from your device.
These Terms constitute the entire agreement between you and Eureki Unipessoal Lda. regarding the app.
3. What is Eureki
Eureki is a mobile application for personal mentorship through daily micro-steps, assisted by artificial intelligence.
The service includes:
- Learning plan generated from your goal
- "Daily drop" — concrete micro-step to execute in 5-15 minutes
- Ask Eureki chat for contextual questions
- Local personal notes
- Optional Pro subscription with advanced features
Eureki is NOT:
- A medical, psychological, psychiatric, or therapeutic service
- Professional advice (legal, financial, formal educational)
- A certified teaching platform
- A substitute for qualified professionals in any field
4. Account and authentication
Using the app does not mandatorily require an email account. By default, authentication is anonymous (Firebase UID).
You can optionally create an account with email and password. In that case:
- You are responsible for keeping your credentials confidential
- You are responsible for all activity on your account
- You must notify us immediately at
support@eureki.appif you suspect unauthorized access
Eureki reserves the right to refuse account creation, suspend sessions, or terminate accounts when a violation of these Terms is detected.
5. Acceptable use
You agree to use the app lawfully, ethically, and in accordance with these Terms. In particular, you may not:
- Use the app for illegal, abusive, offensive purposes, or in ways that violate third-party rights
- Interfere with the technical operation of the app or backend
- Attempt to gain unauthorized access to systems, data, or other users' accounts
- Reverse engineer, decompile, disassemble, or extract source code
- Attempt to extract internal prompts, API keys, or proprietary AI model configurations
- Use the app automatically (bots, scrapers) without written authorization
- Create derivative works, adaptations, or copies of the app
- Resell, sublicense, or distribute access to the app
6. Pro Subscription
Eureki offers two tiers:
- Free — free, with limited features (including daily Ask limit and access to pre-curated goals)
- Pro — paid subscription, with advanced features:
- Monthly: price published on the Google Play Store
- Annual: price published on the Google Play Store, with a 30-day free trial on first activation
Prices, trials, and conditions are managed and communicated by the Google Play Store and processed by RevenueCat.
6.1 Renewal and cancellation
- Subscriptions renew automatically at the end of each period, unless cancelled at least 24 hours before renewal
- To cancel: Play Store → Account → Subscriptions → Eureki → Cancel
- Cancellation takes effect at the end of the current paid period
- No prorated refund for unused partial periods
6.2 Trial
- The 30-day trial applies only to the annual plan and only on first activation per account
- Automatic billing at the end of the trial, unless cancelled before
- Trial-end notifications may be sent by the Google Play Store
6.3 Refunds
Refunds are managed by the Google Play Store under its policy. You can
check at play.google.com/store/account/orderhistory.
7. AI-generated content — limitations
Eureki uses AI language models (OpenAI, Mistral) to generate:
- Learning plans
- Daily drops
- Ask Eureki replies
Important limitations:
- AI-generated content may contain errors, inaccuracies, or outdated information
- It is not professional advice of any kind
- It does not replace formal training, specialized books, or qualified human mentors
- On topics with legal, medical, financial, or safety impact, always consult a competent professional
By using Eureki, you acknowledge that you are responsible for critically validating the generated content and the decisions you make based on it.
8. Content you create
Notes, goals, and questions you submit remain your property.
By using Eureki, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Store locally or on the backend (strictly as needed to provide the service)
- Send to AI sub-processors (OpenAI, Mistral) to generate the response
- Process in aggregate (without personal identification) to improve the service
This license ends when you delete your account (see Section 12).
9. Eureki's intellectual property
The Eureki app, brand, design, source code, icons, animations, curated editorial content, internal AI prompts, and backend infrastructure are exclusive property of Eureki Unipessoal Lda.
You may not copy, modify, distribute, sublicense, sell, publicly display, publish, or create derivative works without our prior express written authorization.
Violations will be addressed under the Portuguese Copyright and Related Rights Code (Decree-Law No. 63/85) and the Industrial Property Code.
10. Service availability
We make reasonable efforts to keep the app and backend available, but we do not guarantee continuous availability nor freedom from errors.
The service may be temporarily unavailable due to:
- Scheduled maintenance
- Sub-processor failures (Firebase, OpenAI, Fly.io, RevenueCat)
- Force majeure causes
We are not liable for losses resulting from temporary unavailability.
11. Limitation of liability
To the maximum extent permitted by applicable law, Eureki Unipessoal Lda. will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Decisions you make based on AI-generated or editorial content from Eureki
- Device failures, local data loss, incompatibilities with Android versions
Eureki's total liability to any user, for any cause, is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim.
Nothing in this clause excludes liability that cannot be excluded by law (e.g., willful misconduct, gross negligence, personal injury).
12. Termination
12.1 By you
- You may delete your account at any time via Settings → Privacy and data → Delete account and data
- Deletion is irreversible: removes remote data, Firebase account, and local data
- If you have an active Pro subscription, payment cancellation must be done separately on the Google Play Store
12.2 By us
We may suspend or terminate your account if:
- You violate these Terms
- You use the app for illegal purposes
- You represent a risk to the service's or other users' security
- We are legally required
In case of termination initiated by us, we will notify you if legally admissible.
13. Changes to Terms
We may update these Terms to reflect changes to the service, legal requirements, or improvements. We will notify you of material changes at the next app startup.
Continuing to use the app after notification means acceptance of the new version. If you disagree, you can delete your account.
14. Governing law and jurisdiction
These Terms are governed by Portuguese law.
Any dispute will be submitted to the exclusive jurisdiction of the courts of the judicial district of Faro, Portugal, with express waiver of any other jurisdiction.
